These Terms of Use ("Terms") govern your access to and use of the website located at mississippimotion.com (the "Site") operated by Action Potential, PLLC on behalf of the Mississippi Motion practice (together, "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. No medical advice
Content on the Site is provided for general informational purposes only. It is not intended as medical advice, diagnosis, or treatment, and it does not create a doctor-patient relationship. 3. Appointments and communications
Features such as "Text to Book," telephone links, or email links are offered for your convenience. Submitting a message or booking request does not guarantee an appointment. Availability, insurance, and clinical suitability are determined during normal business processes. Message and data rates may apply to SMS according to your carrier.

The Site and its content (including text, graphics, logos, layout, and compilation) are owned by us or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may view and print a reasonable number of copies for personal, non-commercial use, provided you do not remove proprietary notices. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US (IF ANY) SPECIFICALLY FOR USE OF THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
8. Indemnity
You agree to defend, indemnify, and hold harmless Action Potential, PLLC, Mississippi Motion, their affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
9. Governing law and venue
These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles that would require application of another jurisdiction's laws. You agree that state or federal courts located in Mississippi will have exclusive jurisdiction over any dispute arising from these Terms or the Site, and you consent to personal jurisdiction there, except where applicable law requires a different forum.
10. Changes to these Terms
We may modify these Terms at any time by posting the updated version on this page and updating the effective date. Your continued use of the Site after the new effective date constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Site.
11. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
12. Entire agreement
These Terms, together with our Privacy Policy where referenced, constitute the entire agreement between you and us regarding the Site and supersede any prior understandings on the same subject.
